PUBLIC OFFER AGREEMENT
MIRATALKS Emotional Support Service
1. General Provisions
1.1. This Public Offer (hereinafter — “Offer”) constitutes a legally binding agreement between MIRATALKS.COM (as a part of registered in Finland ET Plus Oy Company VAT FI-33006193) (hereinafter — “Company”, “We”, “MIRA”) and any private individual regardless of their location (hereinafter — “Client”, “You”). While our core standards are based on EU consumer protection and GDPR, these terms apply to all Clients globally..
1.2. By booking or receiving a support session or any other service through our website/platform, You accept this Offer and agree to comply with its terms.
1.3. This Offer is made under the laws of Finland and EU consumer protection regulations.
2. Nature of Services
2.1. MIRA provides emotional support, listening services and accompanying soft-support practices aimed at emotional relief, reflection and wellbeing.
2.2. MIRA is not a medical organization, not a psychological/psychiatric clinic, not mental-health treatment, emergency service, crisis intervention center, hotline, or rescue service.
2.3. We do not diagnose, treat mental or physical disorders, and do not guarantee therapeutic results.
2.4. The Client confirms they understand that services are supportive and conversational in nature.
3. No Emergency or Life-Threatening Situations
3.1. MIRA does not accept emergency, crisis, life-threatening, suicidal or harm-to-others situations.
3.2. If You are experiencing any form of crisis, You must immediately contact local emergency services in your country (e.g. 112/911) or crisis hotline.
4. Telecommunication Disclaimer
4.1. MIRA is not a telecommunications provider and does not supply electronic communication networks or services.
4.2. Communication tools (phone, internet, messaging platforms) are provided by independent third-party telecom providers.
5. Confidentiality & Data Protection (GDPR)
5.1. All conversations are confidential.
5.2. No session recordings are made.
5.3. We collect and store only minimal data necessary for payment accounting and compliance (such as transaction info, date, time, technical identifiers).
5.4. Data is stored within the Company and is not shared with third parties, except legally required cases (e.g. tax authorities, anti-money-laundering compliance).
5.5. Data processing is carried out in accordance with GDPR and Finnish data protection law.
5.6. You may request access or deletion of your stored personal data by contacting us.
6. Anonymity
6.1. Sessions are designed to maintain Client anonymity to the maximum extent allowed by law.
6.2. Identification data is not requested unless required for legal compliance (e.g. payment system requirements).
7. Payment and Refunds
7.1. Services are paid in advance.
7.2. Payments are processed via secure third-party payment providers.
7.3. For on-demand “session now” services, EU law grants a right of withdrawal, however:
By clicking “I agree to start the service immediately”, You consent to begin the service immediately and acknowledge that once the service is provided, the right to withdraw/cancel is lost.
7.4. If You do not give such consent, service may begin only after the 14-day withdrawal period.
7.5. Refunds for completed sessions are not provided.
7.6. All prices for EU consumers are inclusive of Finnish VAT at the current applicable rate (25.5%) unless otherwise stated.
For Clients located within the European Union, the Service price includes VAT at the applicable Finnish rate. For Clients located outside the European Union, the Service is provided as an export of services, and the Client may be responsible for any local taxes or duties applicable in their jurisdiction. MIRA applies a 0% VAT rate for non-EU residents in accordance with Finnish Tax Administration (Vero) regulations.
8. Client Responsibility
8.1. The Client confirms they are at least 18 years old.
8.2. The Client provides honest information regarding their emotional state and refrains from seeking emergency assistance through MIRA.
8.3. The Client agrees not to misuse the service.
8.4. The Client agrees to maintain a respectful tone. MIRA reserves the right to terminate the session immediately without a refund if the Client uses hate speech, sexual harassment, threats, or aggressive behavior towards the Listener
9. Company Responsibility
9.1. MIRA provides services with due care and respect.
9.2. MIRA is not liable for any indirect or psychological consequences; responsibility for personal decisions remains with the Client.
9.3. MIRA is not responsible for telecom failures or technical interruptions beyond our control.
10. Governing Law
10.1. This Offer and all relations between the Client and the Company are governed by the laws of Finland.
10.2. Disputes shall be settled through negotiation; if unresolved, in competent Finnish courts without prejudice to the consumer's right to bring proceedings in their country of residence as per EU regulations
11. Final Provisions
11.1. This Offer comes into force at the moment of acceptance on the website.
11.2. The Company may change the Offer text; updated versions apply from publication date.
11.3. Continued use of the service equals acceptance of updated terms.
